These SMS Terms of Service (“SMS Terms”) govern your use of text messaging communications with Velocity Sports Management Inc. (“VSM,” “we,” “us,” or “our”). By providing your mobile phone number and opting in to receive text messages from VSM, you agree to these SMS Terms. These SMS Terms supplement our Privacy Policy and Terms of Service.

If you do not agree to these SMS Terms, do not opt in to receive text messages from VSM.


1. Program Description

The Velocity Sports Management SMS program (“Program”) is an opt-in messaging service that delivers automated, operational text messages to participants and their parents or legal guardians regarding youth sports program activities. Messages are sent from our toll-free number ending in 7520. Every message identifies “Velocity Sports Management” as the sender.

Message Categories

When you opt in, you may receive any or all of the following message types:

  • Practice notifications — schedule announcements, location reminders, and last-minute changes
  • Game notifications — game schedules, opponent details, and venue information
  • Cancellations and reschedules — weather-related cancellations, time changes, and venue updates
  • Snack-signup reminders — for scheduled games where you have signed up to bring snacks
  • Coach communications — when a coach posts a stat, measurable, or media item to your athlete’s own profile
  • Event announcements — new camps, clinics, tournaments, and registration windows for activities the recipient is enrolled in
  • Waiver and form reminders — when documents require signature
  • Medical communications — generic alerts that a doctor or medical staff member has sent a secure message in the portal (no protected health information is transmitted via SMS)
  • Direct messages — when another portal user (coach, parent, athlete, or administrator) sends you a portal message
  • Verification codes — one-time codes for phone number verification and account security

You may adjust which categories you receive at any time in the portal under Settings → Notification Preferences.


2. How to Opt In

You can opt in to receive SMS messages from VSM in any of the following ways:

  1. At registration: When creating an account at https://velocitysm.com/vsm-athlete-register, provide your mobile number and check the standalone, unchecked-by-default SMS consent box.
  2. As a parent adding a child: When adding a minor athlete to your parent account, provide your own mobile number and check the standalone SMS consent box.
  3. From Settings: Log in to the portal, go to Settings → Notification Preferences, enter your mobile number, check the SMS consent box, and request a verification code.
  4. By replying START: If you have previously opted out, reply START, UNSTOP, or YES to a VSM number to re-subscribe.

In all cases, the SMS opt-in checkbox is separate, unchecked by default, and not bundled with any other agreement (these SMS Terms, our Terms of Service, our Privacy Policy, parental waivers, or program registration). Consent to receive SMS messages is not a condition of registration, program participation, or any purchase. You may register for and use the VSM portal without ever providing a phone number or opting in to SMS.

After opting in, you will receive a one-time verification code via SMS. You must enter this code in the portal (or reply with confirmation as instructed) to confirm phone ownership before any program messages will be sent.

Consent Language

When you opt in, you are explicitly agreeing to the following:

I agree to receive recurring text messages from Velocity Sports Management at the phone number provided, including practice and game updates, schedule changes, snack reminders, and program announcements. Message frequency varies (typically 4–8 messages per month). Message and data rates may apply. Reply HELP for help or STOP to unsubscribe at any time. Consent is not a condition of registration or any purchase. We do not share your mobile information with third parties or affiliates for marketing or promotional purposes.


3. Message Frequency

Typical message volume is 4–8 messages per month per recipient, with higher volume during active season weeks (when practices, games, and weather-related schedule changes are most frequent) and lower volume in the off-season.

We do not guarantee a specific message frequency, and frequency may vary based on weather events, schedule changes, championship or tournament periods, or program emergencies.


4. Message and Data Rates

Message and data rates may apply. Standard messaging rates from your wireless carrier apply to all SMS messages you receive from us, including verification codes, program notifications, and confirmation of opt-in or opt-out actions. VSM does not charge a fee for sending SMS messages, but your carrier may charge you based on your individual messaging plan.

If you have questions about your messaging plan or charges, contact your wireless carrier directly. VSM is not responsible for any carrier charges incurred from receiving messages from this Program.


5. How to Opt Out

Opt Out by Text

You can opt out of all VSM SMS messages at any time by replying with any of the following keywords to any message you receive from us:

  • STOP
  • STOPALL
  • UNSUBSCRIBE
  • CANCEL
  • END
  • QUIT

After you send one of these keywords, we will send you a final confirmation message acknowledging your opt-out, after which you will receive no further SMS messages from VSM unless you opt in again.

Opt Out via Portal

You can also revoke SMS consent by logging in to the portal at https://velocitysm.com/vsm-athlete-portal and clicking “Revoke SMS Consent” under Settings → Notification Preferences. This action is recorded with a timestamp and IP address for compliance purposes.

Opt Out via Email

You can email info@velocitysm.com to request opt-out. Provide the mobile number you wish to opt out, and we will process the request within one business day.

Effect of Opt-Out

Opting out applies to your phone number across all VSM message categories. After opting out:

  • You will not receive program SMS notifications
  • You will continue to receive email notifications (if you have an email on file) unless you also disable email under Notification Preferences
  • Your portal account remains active
  • Your athlete’s program participation is not affected
  • You can opt back in at any time using the methods described in Section 2

SMS consent is not a condition of registration, program participation, or any purchase. You may participate in any VSM program without consenting to SMS messages.

7. Carrier Disclosure

We support text messaging through major U.S. wireless carriers, including AT&T, T-Mobile, Verizon Wireless, U.S. Cellular, MetroPCS, Boost Mobile, Cricket Wireless, and others. Wireless carriers are not liable for delayed or undelivered messages.

Message delivery is subject to your carrier’s network availability and the technical capabilities of your mobile device. VSM is not responsible for carrier-related delivery issues.


8. Eligibility and Age Requirements

The SMS Program is available only to U.S. mobile phone numbers. You must be at least 18 years old to opt in to receive SMS messages directly from VSM, or have parental consent.

Athletes under 13 cannot opt in to receive text messages directly. Only the parent or legal guardian on file may opt in, and any SMS messages about a minor athlete go to the parent’s verified phone number, not the child’s.

By opting in, you represent and warrant that:

  • You are at least 18 years of age (or the parent or legal guardian providing consent on behalf of a minor athlete in your account)
  • You are the authorized account holder or user of the mobile phone number provided
  • You have not opted in using a phone number that is not yours or that you do not have permission to use
  • The information you provide at the time of opt-in is accurate and complete

9. Privacy and Mobile Information

We do not share your mobile phone number, SMS opt-in status, or any mobile information with third parties or affiliates for marketing or promotional purposes. Mobile information collected through this SMS Program is used solely to operate the messaging service you have opted in to, and is shared only with our SMS gateway provider (Twilio Inc.) for the technical purpose of delivering messages you have requested.

Information collected through this SMS Program — including your mobile phone number, opt-in timestamp, IP address, the exact consent language displayed at the time of opt-in, and any messages exchanged — is stored securely and used only for the purposes described in these SMS Terms and our Privacy Policy.

We retain SMS consent records, opt-out events, and message logs for at least four (4) years following the most recent activity, as required by FCC and state regulations governing telephone consumer protection.


10. Changes to These SMS Terms

We may update these SMS Terms from time to time. When we make material changes, we will post the updated SMS Terms on our website at https://velocitysm.com/sms-terms-of-service/ with a revised “Last updated” date. For significant changes that affect your rights or the operation of the Program, we will notify active subscribers by SMS or email before the changes take effect.

Your continued use of the SMS Program after changes take effect constitutes your acceptance of the updated SMS Terms. If you do not agree to the updated SMS Terms, you must opt out using the methods described in Section 5.


11. Disclaimers and Limitation of Liability

The SMS Program is provided “as is” without warranty of any kind. VSM makes no guarantees regarding message delivery times, message content accuracy, or uninterrupted service.

To the fullest extent permitted by law, VSM, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the SMS Program, including but not limited to lost data, lost opportunities, missed events, or carrier-related charges.

VSM’s total liability under these SMS Terms shall not exceed the greater of (a) the amount you paid VSM in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).

Nothing in this section limits liability that cannot be limited by applicable law.


12. Governing Law and Disputes

These SMS Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising from or related to these SMS Terms or the SMS Program shall be resolved in the state or federal courts located in Harris County, Texas, and you consent to the exclusive jurisdiction and venue of such courts.

If any provision of these SMS Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.


13. Compliance Statement

VSM operates this SMS Program in compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the CTIA Messaging Principles and Best Practices, applicable Federal Communications Commission (FCC) regulations, and the carrier no-share requirement for mobile data. Our SMS sender (Twilio Inc.) is a registered telecommunications service provider with U.S. carriers.
