These Terms of Service (“Terms”) govern your use of the Velocity Sports Management Inc. Athlete Portal at velocitysm.com (the “Service”) operated by Velocity Sports Management Inc. (“VSM,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility & Account Registration
You must be at least 18 years old to create your own account, or have a parent or legal guardian register and manage an account on your behalf if you are under 18. By creating an account you represent that the information you provide is accurate and complete.
2. Parent / Guardian Accounts
Parents or guardians may create accounts to manage minor athletes. The parent or guardian is responsible for the accuracy of their child’s information, for monitoring their child’s use of the Service, and for ensuring the child complies with these Terms.
3. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or to violate any applicable law or regulation
- Impersonate any person or entity, or misrepresent your affiliation
- Upload or share content that is defamatory, harassing, threatening, obscene, or that infringes on the rights of others
- Attempt to gain unauthorized access to any account or to disrupt the operation of the Service
- Use automated tools to scrape, harvest, or extract data from the Service except as permitted by our published API
- Share login credentials with unauthorized persons
- Submit false or misleading medical or biometric information
4. Content You Submit
You retain ownership of content you submit (profile information, photos, video links, medical records, wearable data). By submitting content, you grant VSM a non-exclusive, royalty-free license to use that content as necessary to operate the Service, including displaying it to authorized viewers (coaches, doctors, parents, admins) and storing it on our servers.
5. Athletic Activity Risks & Liability
Participation in athletic activities organized by VSM involves inherent risks of physical injury. Use of the Service does not eliminate these risks. By registering for VSM programs, athletes and their parents/guardians acknowledge these risks. Specific waivers signed within the Service govern the legal aspects of program participation.
6. Medical Information & Wearable Data
The Service stores medical records and biometric data uploaded by athletes, parents, and assigned doctors. The Service is not a substitute for professional medical advice, diagnosis, or treatment. For medical emergencies, call 911. Wearable device data is provided for informational and program-monitoring purposes only and should not be relied upon for clinical decisions outside the context of a doctor-patient relationship.
For athletes under 18, medical communications and records are routed to a parent or guardian account on file, in compliance with applicable child-privacy laws.
7. Notifications and SMS / Text Messages
7.1 Operational Notifications
By creating an account you consent to receive operational emails and in-app notifications from us related to your use of the Service, including account confirmations, security alerts, and important updates about VSM programs. These communications are part of the Service and cannot be opted out of without closing your account.
7.2 SMS / Text Message Program
VSM operates an SMS notification program (“SMS Program”) through which we send transactional text messages to users who have explicitly opted in. Participation in the SMS Program is voluntary, and consent is not a condition of program participation, account creation, or any purchase.
Opt-In. You may opt in to receive SMS notifications by entering and verifying your mobile phone number through your account’s Notification Preferences. Opting in requires you to (a) provide a valid US mobile phone number, (b) check an explicit consent checkbox indicating you agree to receive automated text messages, and (c) verify ownership of the phone number by entering a 6-digit code we text to that number. SMS notifications are off by default; you must opt in per category.
Message Categories. SMS messages may include:
- Practice and game schedule notifications, including new schedules and changes
- Practice and game cancellation alerts
- New message alerts when a coach, parent, doctor, or admin has sent you a portal message
- Coach activity alerts when a stat, measurable, or media item is posted to an athlete’s profile
- Event registration confirmations and reminders
- Waiver-signature reminders
- Generic alerts for new secure medical messages (the alert itself contains no protected health information; you must log into the portal to view medical content)
Frequency. Message frequency varies based on your activity in the portal and the categories you have opted in to. Typical frequency is 0–10 messages per week.
Costs. Standard message and data rates may apply per your mobile carrier’s plan. We do not charge for the messages themselves. We are not liable for delayed or undelivered messages.
Opt-Out. You may opt out of SMS messages at any time by:
- Replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any text message from us, or
- Disabling SMS notifications in your account’s Notification Preferences settings.
After opting out, you will receive a confirmation message and no further SMS will be sent unless you re-subscribe by replying START, JOIN, YES, SUBSCRIBE, or UNSTOP, or by re-enabling SMS notifications in your account settings.

Carrier Disclaimer. Mobile carriers are not liable for delayed or undelivered messages. Service availability and message delivery are subject to your wireless carrier’s network availability and your device’s reception.
Privacy. Your mobile number is never sold, rented, or shared with third parties for marketing purposes. SMS data is shared only with our SMS gateway provider (Twilio Inc.) for the purpose of delivering messages you have requested. See our Privacy Policy for full data-handling practices.
Updating Your Number. If you change your mobile number, you are responsible for updating your account or opting out from the old number. We are not liable for messages sent to a number that was reassigned by your carrier without our knowledge.
Eligibility. The SMS Program is available only to US mobile phone numbers. Users must be at least 18 years old, or have parental consent, to opt in.
8. Fees & Payment
Some VSM programs require a registration fee. Fees are clearly disclosed at the time of registration. All fees are non-refundable except as required by law or as expressly stated in our refund policy.
9. Intellectual Property
All Service content not submitted by users — including the VSM logo, brand, software, design, and documentation — is the property of Velocity Sports Management Inc. and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our written permission.
10. Termination
We may suspend or terminate your account at any time for violation of these Terms, for non-payment of fees, or for conduct that we determine to be harmful to other users or to VSM. You may request deletion of your account at any time by contacting info@velocitysm.com.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, VELOCITY SPORTS MANAGEMENT INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE PAST 12 MONTHS.
13. Indemnification
You agree to indemnify and hold harmless Velocity Sports Management Inc., its officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any third party’s rights.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws provisions. Any dispute shall be resolved in the state or federal courts located in Harris County, Texas.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the portal. Continued use after changes constitutes acceptance.
